These Terms and Conditions (the "Agreement") govern your use of Tory Furnishings' ("Company," "we," "our," or "us") services, website, and any related offerings, including purchases and communications. By engaging with our services or making a purchase, you agree to these Terms and Conditions. If you do not agree, please refrain from using our services.
1. Definitions
1.1. Client: Refers to any individual, company, or entity purchasing services or products from Tory Furnishings.
1.2. Products: Refers to furniture, furnishings, or any goods provided by Tory Furnishings.
1.3. Services: Includes design consultations, bespoke furniture solutions, delivery, and installation services offered by Tory Furnishings.
1.4. Agreement: Refers to these Terms and Conditions and any additional written agreements entered into by the Client and Tory Furnishings.
2. Scope of Services
2.1. Custom Furniture and Design: All custom furniture orders are subject to a detailed specification agreement, including dimensions, materials, and design preferences.
2.2. Consultations: Free consultations are offered but are subject to scheduling availability. Additional consultations may incur fees.
2.3. Delivery and Installation: Services are provided based on the scope of the order. Delivery timelines are estimated and subject to delays outside of our control (e.g., weather, logistics disruptions).
3. Orders and Payments
3.1. Order Confirmation: Orders are only confirmed upon receipt of a deposit or full payment, depending on the agreement.
3.2. Payment Terms: A deposit of 20% is required for custom orders. Remaining balances are due 2 prior to delivery.
3.3. Currency: All payments must be made in Canadian Dollars (CAD).
3.4. Late Payments: Payments not received by the due date will incur a 2% late fee per month.
4. Pricing and Taxes
4.1. Pricing: Prices are subject to change without notice. Quotes provided are valid for 2.
4.2. Taxes: All applicable sales taxes, including HST, are the responsibility of the Client and will be included in invoices.
5. Cancellation and Refund Policy
5.1. Cancellations by Client: Orders canceled within 2 of confirmation will incur a 5% cancellation fee. Custom orders cannot be canceled once production has started.
5.2. Refunds: Refunds are only issued for defective products as determined by Tory Furnishings.
6. Shipping and Delivery
6.1. Delivery Timelines: Estimated delivery dates are not guaranteed. Delays may occur due to external factors.
6.2. Delivery Costs: Fees for delivery will be outlined in the order confirmation and are subject to change based on location and circumstances.
6.3. Risk of Loss: Risk passes to the Client upon delivery to the designated address.
7. Warranty and Product Care
7.1. Warranty Period: Tory Furnishings offers a limited warranty of 1 year for manufacturing defects.
7.2. Exclusions: Warranty does not cover normal wear and tear, misuse, or modifications made by the Client.
7.3. Care Instructions: Clients must follow product care instructions provided to maintain warranty validity.
8. Intellectual Property
8.1. All designs, trademarks, and logos used by Tory Furnishings are the property of the Company.
8.2. Use of our intellectual property without written consent is prohibited.
9. Limitation of Liability
9.1. Tory Furnishings is not liable for:
Delays caused by third-party suppliers or couriers.
Damage to property during delivery beyond our direct control.
9.2. Liability for damages is limited to the value of the order.
10. Privacy and Data Protection
10.1. Tory Furnishings is committed to protecting Client data under the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA).

11. Governing Law
11.1. This Agreement is governed by the laws of Canada.
11.2. Any disputes shall be resolved in the courts of Canada.
12. Amendments and Updates
12.1. Tory Furnishings reserves the right to update these Terms and Conditions at any time.
12.2. Clients will be notified of significant changes via email or public notice on our website.
13. Force Majeure
13.1. Tory Furnishings is not liable for failure to perform due to events beyond our reasonable control, including natural disasters, labor strikes, and governmental actions.
14. Dispute Resolution
14.1. Clients agree to resolve disputes through mediation or arbitration before pursuing legal action. 14.2. Arbitration shall be conducted under lawys held in Canada.
